General Terms and Conditions of fairair.eu (version 2025)
In these Terms and Conditions the following terms shall have the following meanings:
2.1 These Terms and Conditions apply to all offers, orders and agreements concluded via fairair.eu.
2.2 Deviations are only valid if agreed in writing.
2.3 Any terms and conditions or purchase conditions of the Customer are expressly excluded.
2.4 If any provision is invalid in whole or in part, the remaining provisions shall remain in full force.
2.5 fairair.eu may amend these Terms and Conditions. Material changes will be communicated in a timely manner, for example via the Website or by email.
3.1 All offers made by fairair.eu are non-binding unless expressly stated otherwise.
3.2 Obvious mistakes, typographical errors, printing errors, programming errors or incorrect product information shall not bind fairair.eu.
3.3 The Agreement is concluded when the Customer accepts the offer and fulfils the applicable conditions.
3.4 fairair.eu confirms the order electronically. Until this confirmation has been sent, the Customer may cancel the Agreement.
3.5 fairair.eu may, within statutory limits, investigate whether the Customer can meet its payment obligations and may refuse an order, request additional information or attach special conditions.
3.6 The administration of fairair.eu shall serve as evidence, subject to evidence to the contrary, of orders, payments and deliveries. Electronic communication may serve as evidence.
4.1 All prices are in euros and include VAT, unless stated otherwise. Shipping costs are calculated separately and shown before completion of the order.
4.2 fairair.eu determines the delivery method and may deliver orders in parts.
4.3 For Consumer Customers, the risk of loss or damage passes when the Consumer Customer or a third party designated by the Consumer Customer receives the Product. For Business Customers, the risk passes when the Product is handed over to the carrier, unless otherwise agreed.
4.4 For international orders, any bank charges, import VAT, customs duties and handling fees are for the account of the Customer.
4.5 Customers outside the Netherlands may not pay by direct debit unless fairair.eu expressly agrees otherwise.
Following the United Kingdom’s withdrawal from the European Union (Brexit), shipments from the EU to the United Kingdom are considered imports. As a result, import VAT, customs duties and handling fees may apply. This generally also applies to shipments to other countries outside the European Union.
For orders shipped to the United Kingdom:
For goods with a value of £135 or less, UK VAT is typically included at checkout and normally no additional charges should apply upon delivery, unless exceptions apply.
The Customer is responsible for all import VAT, customs duties and handling fees applicable in the United Kingdom and other non-EU countries. We recommend that Customers inform themselves about the applicable import rules in the destination country before placing an order.

5.1 If no specific delivery date has been agreed, delivery within the European Union shall take place as soon as possible and no later than 30 calendar days after conclusion of the Agreement.
5.2 Delivery outside the European Union shall take place within a reasonable period.
5.3 If delivery is delayed, fairair.eu will inform the Customer as soon as possible.
5.4 If fairair.eu fails to deliver within the agreed or statutory delivery period, the Consumer Customer may request delivery within an appropriate additional period. If fairair.eu does not deliver within that additional period, the Consumer Customer may terminate the Agreement.
6.1 The Consumer Customer has the right to withdraw from the Agreement within 14 calendar days after receipt of the Product without giving any reason.
6.2 The Consumer Customer must inform fairair.eu in writing or by email within the withdrawal period.
6.3 The Consumer Customer must return the Product as soon as possible and no later than 14 calendar days after notifying fairair.eu of the withdrawal.
6.4 Return shipping costs are borne by the Consumer Customer unless fairair.eu has stated otherwise.
6.5 fairair.eu will refund the received payment, including the standard outbound shipping costs, within 14 calendar days after being informed of the withdrawal. fairair.eu may withhold reimbursement until it has received the Product or until the Consumer Customer has provided proof of return shipment.
6.6 If the Consumer Customer chose a more expensive delivery method than the cheapest standard delivery, the additional costs will not be refunded.
6.7 The Consumer Customer is liable for any diminished value of the Product resulting from handling beyond what is necessary to determine the nature, characteristics and functioning of the Product.
6.8 The right of withdrawal does not apply to Products made to the Customer’s specifications, Products that are clearly personal in nature, Products that cannot be returned for hygiene reasons once sealed packaging has been opened, or other Products legally excluded from the right of withdrawal.
7.1 fairair.eu warrants that the Products comply with the Agreement, the stated specifications and reasonable requirements of soundness and usability.
7.2 A manufacturer’s warranty may apply to Products. This warranty does not affect the statutory rights of the Consumer Customer.
7.3 Warranty does not apply if a defect results from incorrect use, incorrect storage, improper installation, modification of the Product or use contrary to instructions.
7.4 Complaints about defects must be reported to fairair.eu within a reasonable period after discovery.
8.1 Payment is made via the payment methods offered on the Website.
8.2 If payment by invoice has been agreed, payment must be made within the period stated on the invoice.
8.3 If the Customer does not pay on time, fairair.eu may charge statutory interest and reasonable collection costs, to the extent permitted by applicable law.
8.4 Objections to an invoice do not suspend the payment obligation unless the law provides otherwise.
9.1 All Products delivered remain the property of fairair.eu until the Customer has fully met all payment obligations under the Agreement.
9.2 The Customer may not pledge, encumber or otherwise use Products subject to retention of title in a manner that conflicts with the ownership rights of fairair.eu.
10.1 fairair.eu is only liable for direct damage that is the direct result of an attributable failure by fairair.eu.
10.2 fairair.eu is not liable for indirect damage, including consequential damage, loss of profit, missed savings or business interruption, to the extent permitted by law.
10.3 The liability of fairair.eu is limited to the invoice amount of the relevant order, unless the damage results from intent or gross negligence by fairair.eu.
10.4 For Consumer Customers, these limitations apply only to the extent permitted by mandatory consumer law.
11.1 Complaints about delivery, quality, condition of the Product or other matters must be reported to fairair.eu customer service.
11.2 The Customer must include the order number and a clear description of the complaint.
11.3 fairair.eu will respond within 14 calendar days after receipt of the complaint. If more time is required, fairair.eu will inform the Customer within this period of the expected response time.
12.1 fairair.eu processes personal data in accordance with the General Data Protection Regulation (GDPR) and applicable Dutch privacy legislation.
12.2 fairair.eu uses personal data for processing orders, customer service, payment, shipping and other purposes necessary for the performance of the Agreement.
12.3 Personal data is not sold to third parties. Data may be shared with parties necessary for the performance of the Agreement, such as carriers, payment providers and IT service providers.
12.4 The Customer may request access, correction, deletion or restriction of personal data, to the extent permitted by law.

14.1 All Agreements with fairair.eu are governed by Dutch law.
14.2 Disputes shall be submitted to the competent court in the Netherlands, unless mandatory law provides otherwise.
14.3 Consumer Customers may also bring a dispute before the court that has jurisdiction under mandatory consumer law.
14.4 The applicability of the United Nations Convention on Contracts for the International Sale of Goods is excluded.
